1. General

1.1. These General Terms and Conditions („T&Cs“) apply to participation in and the associated ticket sales for the above event. Deviating terms and conditions of the participant are invalid.

1.2. The organiser reserves the right to make changes and additions to these rules. Any potential changes and additions will become valid upon publication on this internet page or on the event page. www.machn-festival.de.

2. Registration and conclusion of contract

2.1. Registration for participation in the event is exclusively online via the organiser's conference management platform.

2.2. The organiser makes an offer to conclude a contract with the details provided on the website. The participant, in turn, makes a binding offer by completing the order process and clicking the „Buy now for a fee“ button in the final order mask. These are exclusively personalised tickets.

2.3. The agreement to participate in the event will only come into effect once the organiser has confirmed the registration to the participant in writing via email.

3. Prices

3.1. The price stated on the confirmation of participation is the final price and binding on the participant.

3.2. All prices include VAT where applicable.

3.3. Where special prices are granted for concessions (students, members of certain organisations, etc.), this will also be indicated separately. The concessionary rate must be proven upon request by presenting appropriate documentation (student ID, university confirmation, membership number). The concessionary entitlement must still be valid at the start of the event. If proof cannot be provided, the difference between the full price and the concessionary price must be paid by the participant at the start of the event in order to be granted entry.

4. Payment

4.1 Payment shall be made via the methods indicated on the website (via MasterCard and Visa credit cards, PayPal, or bank transfer).

4.2. Should a payment be reversed (e.g. due to insufficient funds in the account provided at the time of ordering), the participant shall reimburse the organiser for any damage or expenses incurred in this regard. This includes, in particular, bank charges and a processing fee of €10.00 per chargeback for the organiser's administrative costs.

4.3 In the event of an unjustified chargeback, an administration fee of EUR 40.00 will be charged.

In the event of a chargeback, the participant will forfeit their right to attend the booked event. This does not affect any further claims the organiser may have against the participant.

5. Right of Withdrawal

The right of withdrawal is excluded according to § 312 g para. 2 sentence 1 no. 9 of the German Civil Code (BGB) because the MACHN Festival is an event with fixed dates. However, a transfer of the personalised tickets is possible.

6. Benefits

The scope of contractual performance in relation to the event shall be determined by the information materials, details on the event website, any registration forms available, and the organiser's confirmation of attendance. In the event of contradictions, and in all cases, the description of services in the booking confirmation shall be decisive.

7. Cancellation of the Event

7.1. For urgent reasons, the organiser may cancel the event with reasonable notice. This also applies to supporting and evening programmes.

7.2. In the event of cancellation of the event, the organiser shall refund the payment made in full within 14 days. Costs incurred by the participant in addition thereto will not be refunded.

8. Copyright and Other Rights

8.1. The lectures and event materials provided are protected by copyright and may only be used for personal use. Usage rights are only transferred through express written granting of usage rights. Any kind of duplication, distribution, processing, or public performance is generally not permitted and requires the written consent of the organiser.

8.2. Audio and video recordings and descriptions of the event, in whole or in part, are not permitted.

9. Images/Photographs

The participants of the event irrevocably and free of charge consent to the organiser being entitled to create, reproduce, broadcast or have broadcast image and/or sound recordings of their person that go beyond the depiction of a current events presentation, as well as to use them in audiovisual media.

10. Liability

10.1. There is no statutory warranty.

10.2. The organiser shall be liable for damages arising from injury to life, body or health, as well as for damages based on wilful intent or gross negligence on the part of the organiser (the same applies to its legal representatives or vicarious agents), and for damages in the event of non-compliance with a given guarantee.

Furthermore, liability is limited to the reimbursement of foreseeable, contractually typical damages resulting from a slightly negligent breach of essential contractual obligations by the organiser or their legal representatives/vicarious agents.

10.3. All further claims for damages are excluded. This does not apply to provisions under the Product Liability Act.

11. Final Provisions

11.1. The place of jurisdiction is Leipzig.

11.2. Should individual provisions of these T&Cs be invalid or lose their validity due to a later-occurring circumstance, the validity of the T&Cs shall remain unaffected in all other respects. In place of the invalid provisions, a regulation that comes closest to what the contracting parties would have intended if they had considered the relevant point shall apply. The same applies to gaps in these T&Cs.
